TERMS OF USE & DIGITAL LICENSE (ENGLISH VERSION)

This document sets forth the legal terms and conditions governing the use of all digital products purchased from the website TheDigitalStore. By purchasing any digital product, you agree to abide by the following license terms. These terms become effective immediately upon completion of the transaction and receipt of the file.

1. DIGITAL PRODUCT AND INTELLECTUAL PROPERTY RIGHTS

All brushes (Procreate Brushes), PNG files (Clipart), Templates, and any other digital products (hereinafter the “Products”) purchased from this site are the property of TheDigitalStore and are protected by copyright laws.

The purchase of a Product grants you a non-exclusive, non-transferable license to use the Product in accordance with the terms set forth below. Ownership rights to the Products are not transferred.

2. STANDARD COMMERCIAL LICENSE (INCLUDED)

The Standard License included with your purchase permits you to use the Products for both personal and commercial purposes, subject to the following conditions:

Permitted Uses:

1. Personal Use: Use of the Products in any personal creative, artistic, and educational projects.

2. Commercial Use (Included): Use of the Products in the creation of new, modified end products for your clients.

   • Example 1: An architect uses PNG figures or brushes to create a commercial architectural render (a finished drawing, image, or presentation) for their client.

   • Example 2: A designer uses stamp brushes to create a unique interior sketch that forms part of their paid design project.

   • Example 3: Creation of physical printed materials (e.g., posters, notepads) where the Product is only one element of the overall, original design.

Strictly Prohibited Uses (License Violation):

1. Resale and Distribution: You may not sell, resell, sublicense, exchange, rent, or otherwise distribute the Products or their modified versions as digital assets.

   • This means: you cannot sell a PNG tree file that you bought from us as a standalone PNG clipart product.

2. Creation of Derivative Digital Products: You may not create new brushes, stamps, templates, digital papers, clipart, or any other digital tools that are based on or are a direct result of the purchased Products, and sell them.

3. Embedding: Embedding the Products into final software, games, or tools where the Products can be extracted or utilized by end-users.

3. DIGITAL DELIVERY AND REFUND POLICY

1. Delivery Format: All Products are delivered as a digital file (e.g., ZIP file with a download link, PDF file, or direct download) immediately upon payment confirmation.

2. No Physical Item: You will not receive any physical item via mail.

3. Refund Policy: Due to the digital nature of the Products, which makes their return impossible, refunds for purchased Products will not be provided.

4. Technical Support: If you experience any issues with downloading, installing, or using the Products, please contact us at texturedrape@gmail.com. We are committed to providing technical support to resolve problems.

4. EXTENDED LICENSE

If you require usage of the Product for broader purposes than permitted by the Standard License (e.g., mass production of goods, resale of "as is" products, or usage for purposes explicitly forbidden in Section 2), you must purchase an Extended Commercial License. Please contact us to discuss the terms and cost of such a license.
